I was told recently that :

Regarding women over 55:

Older women can obtain a K-1 visa from the USA without a personal visit from the men to Ukraine....just an invitation is necessary.

Is this true?

Alledgedly there is a hardship clause (demostratable hardship that prevents you from meeting)... I am unaware of an age exception....

There is a hardship clause.

I tried it (i'm on dialysis) and was rejected. So, it seems like it is hard to get a visa this way.

No. A I-129 K1 Visa is for thePetition of Alien Fiancee. You still have to follow the law and everyone must do the same things. There is a medical, an interview, to name a few things. People do get refused status too.

Once you apply though, can take a few months to even a year. This is depending on the work load. These laws can be found at: uscis.gov. It will tell you the time expected and requirements. I do suggest, not getting an attorney and wasting your money. The forms are spelled out very clearly, and as long as you follow the instructions you should not have an issue. But, to answer your question, USCIS, also looks at the burden upon the US to allow someone in.

If you want someone in, follow the process of the K1 or do the K3. The K3 is for being married to a USC. This process can be shorter, but all depends on the workload.
